Salem ADU Ordinance Survey

In May of 2021, the Salem City Council adopted an accessory dwelling unit (ADU) ordinance. The ordinance allows for by-right construction of ADUs within the principal structure of a property or attached to the principal structure within zoning setbacks. Additionally, ADUs can be built within an existing detached accessory building (e.g., a detached garage) provided that the detached accessory structure was built prior to March 2021.
However, to obtain a building permit the ordinance also mandates a rental control measure limiting rent to 70% of HUD Fair Market Value. Other requirements/restrictions include:
- Maximum 900 sq. ft.
- Detached structures are not allowed (if they were not built before March 2021)
- Single meter utilities required
- 2-bedroom maximum
- Owner occupancy is required
