Attorney General Sues Town Over Non-Compliance of MBTA Communities Law

Attorney General Andrea Campbell has followed through on her promise and is suing a Massachusetts community for failing to comply with the MBTA Communities Law. Milton voters recently voted to reject an MBTA Communities Law compliance plan to build more affordable housing near public transit stations, despite the governor and AG’s threat to sanction any community that fails to comply. Punishments include and are not limited to grant funding disqualification and legal action. Former governor Charlie Baker signed the MBTA Communities Act into law in 2021, with the intent to help solve the state’s housing crisis. The law requires communities served by the MBTA to offer at zoning district for affordable multi-family housing.
